Vocabie — Terms of Service

Welcome to Vocabie! Vocabie is developed and operated by Cengiz Kuscu, an individual developer, and published under the "CygoLabs" brand name. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Cengiz Kuscu ("we", "our", "us", or "Vocabie") regarding your access to and use of the Vocabie mobile and desktop applications and related educational services (collectively, the "Services").

By downloading, installing, accessing, or using Vocabie, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with all of these Terms, you must immediately cease using and uninstall the App.

1. Description of Services

Vocabie is a language learning companion application that enables users to:

  • Create, manage, and study customized vocabulary flashcards.
  • Utilize an algorithmically managed spaced repetition system (SM-2) to optimize memory retention.
  • Access an AI-assisted communal dictionary providing definitions, parts of speech, translations, and contextual example sentences across supported language pairs.
  • Track personal learning statistics, daily study streaks, and study quota milestones.

We reserve the right to modify, update, suspend, or discontinue any aspect or feature of the Services at any time with or without notice. This includes requiring you to install a mandatory application update, or temporarily suspending access to the Services for scheduled maintenance, before you can continue using the App.

2. Eligibility & User Accounts

A. Age Requirements

You must be at least 13 years of age (or 16 years of age in the European Economic Area / United Kingdom) to use the Services. If you are under the legal age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

B. Account Types & Registration

  • Sign in with Apple / Google: You may create an account using your Apple ID or Google account. You agree to maintain the security of your authentication credentials and notify us immediately of any unauthorized use.
  • Guest (Anonymous) Mode: You may use Vocabie as a Guest without providing an email. Guest accounts have access to local study features and limited cloud quotas. We strongly advise linking your Guest account to an Apple or Google account to prevent permanent loss of your vocabulary data upon device reset, app uninstallation, or cache clearing.

C. Account Deletion

You can permanently delete your account and all associated study data at any time through the in-app Settings > Account > Delete Account menu.

3. Subscriptions, Purchases & Billing

Vocabie offers free features alongside optional premium tiers (e.g., Plus, Pro) and one-time credit packages.

A. In-App Purchases (IAP)

  • All payments, subscriptions, and in-app credit purchases are processed directly through the Apple App Store or Google Play Store. We use RevenueCat, Inc. as a subscription management platform to synchronize your entitlement and purchase status across devices; RevenueCat does not process payments itself and has no access to your payment card details.
  • Prices are displayed in your local currency in the app and may vary by region or platform. All prices are inclusive of applicable taxes where required by law.

B. Subscriptions & Automatic Renewal

  • If you purchase an auto-renewing subscription, your subscription will automatically renew at the end of each billing cycle (e.g., monthly or annually) unless canceled at least 24 hours prior to the end of the current period.
  • Your Apple ID or Google Play account will be charged for renewal within 24 hours prior to the end of the current billing cycle.

C. Cancellation & Refunds

  • How to Cancel: You must manage and cancel your subscriptions directly via your device settings (Apple App Store Account Settings or Google Play Subscriptions menu). Uninstalling the application does not automatically cancel your subscription.
  • Refund Policy: All purchases are final and non-refundable, except where required by law or the refund policies of Apple Inc. or Google LLC. Any refund requests must be submitted directly to Apple or Google.

D. Word Quotas & Credit Wallet

  • Free accounts include a recurring monthly word generation quota.
  • For Plus and Pro subscribers, the word generation quota cycle is synchronized with your active subscription's billing period rather than the calendar month; your quota resets each time your subscription renews.
  • Additional word generations can be unlocked through subscription plans or credit packs in your credit wallet. Credits do not expire while your account remains active; unused credits are forfeited on termination, including account deletion, as described in Section 12, except where a refund is required by mandatory law or the refund policies of Apple or Google.
  • Credits have no cash value and cannot be redeemed, transferred, or exchanged for fiat currency.

E. Right of Withdrawal (EU/EEA, UK, and Türkiye consumers)

  • If you are a consumer in the EU/EEA or the United Kingdom, you generally have a 14-day right to withdraw from distance contracts. Subscriptions and credit packs are digital content and digital services that are supplied immediately after purchase.
  • By completing a purchase, you expressly request immediate performance and acknowledge that you lose your right of withdrawal once the digital content has been supplied (for example, once credits are added to your wallet or premium features are unlocked). Where a right of withdrawal still applies under mandatory law, it can be exercised through the refund process of Apple or Google.
  • For consumers in Türkiye, under the Distance Contracts Regulation, the right of withdrawal does not apply to services performed instantly in electronic form and to intangible goods delivered instantly to the consumer, such as credits and premium features.
  • Nothing in these Terms limits any mandatory consumer rights you have under the laws of your country of residence.

4. Intellectual Property & Limited License

A. Ownership

All intellectual property rights in the Services—including the Vocabie name, logo, software code, UI design, graphics, sound effects, algorithms, and documentation—are the exclusive property of Cengiz Kuscu or his licensors.

B. Limited License to Users

Subject to your compliance with these Terms, Vocabie grants you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial educational purposes.

C. Restrictions

You agree that you will not:

  • Copy, modify, decompile, disassemble, reverse engineer, or attempt to derive the source code of the App.
  • Use automated scrapers, bots, crawlers, or extraction tools to harvest data from our dictionary or servers.
  • Circumvent, disable, or tamper with security measures, quotas, entitlement checks, or authentication mechanisms.
  • Resell, rent, lease, sublicense, or commercially exploit the Services or shared dictionary content without our express prior written permission.

5. AI-Assisted Content & Educational Disclaimers

A. "As-Is" Nature of AI Content

Vocabie incorporates artificial intelligence models to assist in generating dictionary entries, definitions, grammar classifications, and example sentences.

  • While we endeavor to provide high-quality linguistic content, AI-generated output may occasionally contain inaccuracies, unnatural phrasing, or errors.
  • The Services and all educational materials are provided for supplemental study purposes "AS IS" without warranties of grammatical infallibility or pedagogical completeness.

B. User Contributions & Error Reports

If you submit dictionary error reports or suggestions, you grant Vocabie a perpetual, royalty-free, worldwide license to use, modify, incorporate, and publish such corrections within our shared dictionary pool for the benefit of all users.

6. Prohibited Conduct

You agree not to engage in any activity that violates these Terms or harms the Vocabie platform or community, including:

  • Submitting abusive, defamatory, obscene, or fraudulent reports or support tickets.
  • Overloading, attacking, or disrupting the integrity and performance of our servers and cloud infrastructure.
  • Using the App for any illegal, unauthorized, or infringing purpose.

We reserve the right to suspend or terminate accounts that engage in prohibited conduct.

7. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • THAT THE APP WILL OPERATE UNINTERRUPTED, SECURE, TIMELY, OR ERROR-FREE.
  • THAT ANY ERRORS IN THE DICTIONARY OR TRANSLATIONS WILL BE IMMEDIATELY CORRECTED.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CENGIZ KUSCU (THE INDIVIDUAL DEVELOPER OF VOCABIE) OR ANY AGENTS ASSISTING IN THE OPERATION OF THE SERVICES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, DEVICE DAMAGE, OR INTERRUPTION OF STUDY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF:

  • THE AMOUNT YOU PAID FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR
  • FIFTY UNITED STATES DOLLARS ($50.00 USD).

9. Indemnification

You agree to defend, indemnify, and hold harmless Cengiz Kuscu and any agents assisting in the operation of the Services from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal and accounting fees) arising out of or in any way connected with your violation of these Terms or your misuse of the Services.

10. Platform-Specific Terms (Apple App Store & Google Play)

If you downloaded the App from the Apple App Store or Google Play Store, you acknowledge and agree that:

  1. These Terms are between you and Vocabie only, and not with Apple Inc. or Google LLC.
  2. Apple and Google have no obligation whatsoever to furnish any maintenance or support services with respect to the App.
  3. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple or Google, and they may refund the purchase price (if applicable) in accordance with their respective refund policies. To the maximum extent permitted by applicable law, Apple and Google will have no other warranty obligation whatsoever.
  4. Apple, Google, and their subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, will have the right to enforce them against you as a third-party beneficiary.
  5. Product claims: We, not Apple or Google, are responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of it, including (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
  6. Intellectual property claims: In the event of any third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights, we, not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
  7. Legal compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
  8. Developer contact: Questions, complaints, or claims regarding the App should be directed to the developer, Cengiz Kuscu, at vocabie@cygolabs.com (see Section 15).
  9. Your use of the App must also comply with the applicable store's usage rules (for example, the Apple Media Services Terms and Conditions) and any applicable third-party agreement terms (such as your wireless data service agreement).

11. Governing Law & Dispute Resolution

These Terms and any dispute arising from or related to them shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law principles, and without prejudice to any mandatory consumer-protection rights you may have under the laws of your country of residence. Any dispute or claim arising out of these Terms shall first be resolved through good-faith informal negotiations prior to initiating any formal legal proceedings, which shall be brought before the courts of the Republic of Turkey to the extent permitted by applicable law.

12. Termination

  • By you: You may stop using the Services at any time and may terminate this agreement by deleting your account (Section 2.C). Deleting your account or uninstalling the App does not cancel an active store subscription; cancel it in your Apple or Google account settings.
  • By us: We may suspend or terminate your access to the Services if you materially breach these Terms (for example, the restrictions in Section 4.C or the prohibited conduct in Section 6), if required by law, or if we discontinue the Services. Except where immediate action is needed to prevent harm or abuse, or where prohibited by law, we will notify you in advance.
  • Effect of termination: Upon termination, your license under Section 4.B ends. Unused credits have no cash value and are forfeited, except where a refund is required by mandatory law or the refund policies of Apple or Google. Sections 4, 5.B, 7, 8, 9, 11, and 13 survive termination.

13. General Provisions

  • Severability: If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
  • Assignment: You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms in connection with a transfer of the App or its operation to another party, provided your rights under these Terms are not reduced.
  • No waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
  • Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Services.

14. Changes to These Terms

We reserve the right to revise or modify these Terms at our sole discretion. If we make material changes, we will provide notice through the App or by updating the "Last Updated" date at the top of these Terms. Your continued use of the Services following the posting of revised Terms constitutes your acceptance of the updated Terms.
